P.P. ----- 05/ 08.07.2025 This anticipatory bail application under Section 482 & 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest for offences under Sections 406/420/34 in connection with Nimiaghat P.S. Case No.08 of 2024 pending in the Court of Judicial Magistrate, First Class, Giridih. 2. On the last date when the matter was heard by a coordinate bench, petitioners had submitted that they will transfer the amount of Rs.14,98,862/- in the account of the informant Vikas Kumar. Today, when the matter is taken up, it has been brought to notice of this Court that an interlocutory application being I.A. No.4900 of 2025 has been filed wherein four months’ time has been prayed in place of three weeks to pay the aforesaid amount. The petitioners admitted that they will pay the aforesaid amount, paragraph Nos.4 & 5 of the interlocutory application read as under:- “ 4. That the petitioner’s are ready to deposit the said 2025:JHHC:18390 2 amount as directed by this Hon’ble court in the order dated 03.04.2025. 5. That the petitioner’s humbly state that the petitioner’s are not able to arrange the said amount within three week’s, therefor the petitioner’s seeks permission to this Hon’ble court to grant further sixteen weeks (4 months) time for depositing the said amount.” The affidavit is sworn by Nnand Kishor Kumar Giri 3. Learned A.P.P. representing the State and Learned informant opposes the prayer for anticipatory bail. 4. Since, the petitioners themselves has volunteered that they will pay Rs.14,98,862/- and now saying that within four months, the same will be paid, I am inclined to allow this anticipatory bail application. 5. In the event of non-payment of the amount, the informant will be at liberty to bring to the notice of the Court about non-payment of the aforesaid amount, which will attract consequences of criminal contempt and other consequences including cancellation of bail. 6. Accordingly, this Anticipatory Bail Application stands allowed. The petitioners, above named, are directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of their surrender or arrest, they shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each, with two sureties of the like amount each, to the satisfaction of learned J.M.F.C., Giridih, in connection with Nimiaghat P.S. Case No.08 of 2024, subject to the condition that one of the bailers should be a close relative of the petitioners and other should be a resident of State of Jharkhand, having sufficient landed property in their name or in the name of their ancestors in which they are having share and to that effect, they have to file an affidavit before the Trial Court indicating their share in the property. 7.
