No.31 of 2024 (State of U.P. Vs. Pushpendra Yadav and another), whereby the learned trial court has rejected the application dated 22.07.2025 moved by the accused for summoning the S.R. File and concerned SHO to prove that the investigation is anti-time. 2. During argument, Ms. Singh sought permission to withdraw the application with liberty to file fresh application for defence evidence before the trial court. 3. Learned A.G.A. has accepted notice on behalf of State-opposite party No.1. 4. There is no need to issue notice to the opposite party no.2. 5. The present application is accordingly dismissed as withdrawn with liberty to the applicant to file fresh application of defence evidence before the trial court.
