CRL OP No. 22039 of 2025 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 12-08-2025 CORAM THE HONOURABLE MR JUSTICE N. SATHISH KUMAR CRL OP No. 22039 of 2025 1. Dr.Shama Parveen W/o.Ameen, No.148, c block, perambalur barracks road, chennai - 600 007. Petitioner(s) Vs 1. The State Rep. by the Commissioner of Police greater chennai police, vepery, chennai - 600007. 2.The Joint Commissioner of Police, East Zone, Egmore, chennai - 600008. 3.The Inspector of Police, Law & Order, G-1, Vepery police Station, Vepery, Chennai – 600007. 4. The Inspector of Police, Crime, G-1, Vepery police Station, Vepery, Chennai – 600007. Respondent(s) https://www.mhc.tn.gov.in/judis CRL OP No. 22039 of 2025 PRAYER Criminal Original Petition filed under section 528 of BNSS to set aside the closure report dated 24.07.2025 passed by 4th respondent Inspector of Police, Crime, G-1 vepery police station, vepery, chennai - 600 007, direct the 4th respondent to register FIR on the petitioners complaint dated 09.05.2025 and investigate the same in accordance with law. For Petitioner(s): Dr.C.Ravichandran for Mr.J.Saravana Vel For Respondent(s): Mr.R.Vinodhraja, Government Advocate [Crl.Side] For R1 To R4 ORDER Challenge has been made to the closure report filed by the fourth respondent dated 24.07.2025, in the present Criminal Original Petition. 2. According to the petitioner, she had lodged a complaint before the fourth respondent on 09.05.2025 against her brother-in-law for alleged verbal abuse and physical assault on her with a water bottle. However, without proper investigation, the Inspector of Police had closed the complaint. Hence, seeks to set aside the said closure report of the fourth respondent. https://www.mhc.tn.gov.in/judis CRL OP No. 22039 of 2025 3. A perusal of the complaint makes it clear that it is a purely family dispute and there is no specific allegation to constitute any offence. Therefore, the investigating officer has closed the complaint. 4. Now it is the contention of the learned counsel appearing for the petitioner that investigation has not been properly done and the closure report of the Inspector of Police has to be set aside. As the investigation Officer has closed the complaint, the remedy for the petitioner is to file necessary private complaint before the concerned Court. In the event negative report is filed, she is also entitled to file a protest petition before the concerned Court. Hence, I do not find any merits in this petition. 5. With the above observations, this Criminal Original Petition is dismissed. 12-08-2025 https://www.mhc.tn.gov.in/judis CRL OP No. 22039 of 2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes Neutral Citation:Yes/No vrc To 1.The Commissioner of Police greater chennai police, vepery, chennai - 600007. 2.Joint Commissioner of Police, East Zone, Egmore, chennai - 600008. 3.Inspector of Police, Law and Order, G-1, vepery police station, vepery, chennai - 600007. 4.Inspector of Police, Crime, G-1, Vepery police station, vepery, chennai - 600 007. 5.
