1. The writ petition bearing WP(C) No. 1364/2025 was
disposed of by a Coordinate Bench of this Court vide order dated 4th of July, 2025 by permitting the petitioner to deposit 10% of the OTS amount within a period of two days and thereafter benefit of OTS scheme was to be extended to the petitioner subject to fulfillment of all other conditions envisaged in OTS Scheme followed by the circular dated 2nd of July, 2025. 2. It is urged by the petitioner that the order was passed only on 4th of July, 2025 and the next following two days viz. 5th and 6th of July were holidays, therefore, the petitioner could apply for the certified copy of the order dated 4th of July 2025 only on 7th of July, 2025, as such, the copy of the said order was issued to the petitioner only on 8th of July, 2025, whereafter, the petitioner went to the respondents on the same day when he was asked to come on 9th of July, 2025 as the respondents were intending to seek directions from the higher authorities. 3. The grievance now projected by the petitioner is that the respondents are not permitting the petitioner to avail the benefit of OTS on account of non-compliance of the direction issued in terms of order dated 4th of July, 2025, whereby the petitioner was required to do the needful within a period of two days. 4. The petitioner, through the medium of this petition, has approached this Court for commanding the respondents to allow him to comply the directions issued by the Coordinate Bench in terms of Order dated 4th of July, 2025. 5. Notice. 6. Notice is waived by Mr. Rabinder Singh, learned Advocate, on behalf of the respondents. He submits that the petitioner has not complied the timeline prescribed by this Court, as such, he is not entitled to any relief. 7. In view of the peculiar facts and circumstances of the case, this Court does not find it necessary to get response from the respondents as the facts are admitted. The petitioner has placed on record even the copy of the application dated 7th of July, 2025 to substantiate the averments made in the writ petition. 8. This Court is satisfied that the petitioner had applied for the issuance of the certified copy only on 7th of July, 2025 as 5th and 6th July of 2025 were holidays.
This fact is also borne from the record that the certified copy was issued on 8th of July, 2025, therefore, this is a fit case where this Court deems it proper to grant further two days time to the petitioner to do the needful in terms of order dated 4th of July, 2025 and in the event the petitioner discharges his obligations in terms of order dated 4th of July, 2025 by Monday, the 4th of August, 2025, the consequences as envisaged in order dated 4th of July, 2025 shall follow. 9. Writ petition shall stand disposed of on the above terms, along with connected CM. 10. In view of urgency expressed at the Bar by the learned counsel for the petitioner, let a copy of this order be issued to learned counsel for the petitioner under the seal and signatures of Bench Secretary of this Court today itself.
