Issue a writ in the nature of Mandamus directing the respondent No.2 to expeditiously proceed and decide the Suit No.78 of 2014 Computerized Suit No. D 2014053100078 (Bal Mukund Lal Vs. State and others) having original no. being 08 of 1999 pending before the Court of Additional District Magistrate City, Gorakhpur Mandal, Gorakhpur under Section 21 (8) of U.P. Administration Building (Rent Control and Eviction) Act, 1972" 3. Learned counsel for the petitioner submitted that proceeding under U.P. Act No.13 of 1972 is pending before respondent No.3- Additional District Magistrate (Administration) Gorakhpur since long. He further placed certified copy of the order sheet, which has been annexed as Annexure No.2 to the writ petition in order to demonstrate that the case is not proceeding expeditiously. 4. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to respondent No.3-Additional District Magistrate (Administration) Gorakhpur to decide the aforementioned case in accordance with law expeditiously and preferably within a period of two months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
