JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 3 20-03-2025 Heard learned counsel for the petitioner and Mr. Arun Kumar Singh, learned APP for the State. 2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 318(4) & 319(2) of the Bharatiya Nyaya Sanhita and under Section 66(C) of I.T. Act. 3. The case of the prosecution is that the petitioner was running All India Classes on his facebook I.D. On this I.D. he posted a message that he is going to release viral question paper and for that he has given link and those who were joining the link have to pay Rs.500/- each. 4. Learned counsel for the petitioner submitted that in this case no paper was leaked. The petitioner has only released mock question papers in name of viral paper due to Patna High Court CR. MISC. No.85561 of 2024(3) dt.20-03-2025 2/2 which he has been apprehended. In this case there is no complainant. The petitioner is having no criminal antecedent. The petitioner is in judicial custody since 05.08.2024. 5. Learned APP appearing for the State has opposed the prayer of regular bail. 6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Gaya Cyber P.S. Case No. 103 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya. durgesh/- (Ashok Kumar Pandey, J) U T
