Hon'ble Ajit Kumar,J. Heard learned counsel for the petitioners as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioners, who have worked during pandemic Covid-19 in the Health Department of district Prayagraj are claiming benefit of the Government
Order dated 27.05.2025 to be re-employed in the event the health workers are being appointed through outsource agencies or otherwise against the vacant positions, may be, on contract basis. It is contended that recently many appointments have been made by Chief Medical Officer, Prayagraj but the claim of those health workers who are known as corona warriors having discharged their duties during pandemic Covid-19, have been ignored. The Government Order dated 27.05.2025 has been brought on record as Annexure No. 3 to the writ petition. Learned Standing Counsel submits that since petitioner has already approached the District Magistrate, Prayagraj, they may also be directed to approach the Chief Medical Officer, Prayagraj afresh and their claims may be directed to be disposed of in accordance with law. Having heard learned counsel for the respective parties and having perused the records, particularly the Government Order dated 27.05.2025 which requires re-employment to be offered to those corona warriors who have discharged their duties during pandemic Corona-19 to be offered direct appointment by way of re-employment through the District Health Committee, it is hereby provided that the petitioners' representation shall be considered and disposed of in terms of Government Order dated 27.05.2025 within a maximum period of two months of presentation of certified copy of this order by the Chief Medical Officer, Prayagraj. The District Magistrate shall also ensure that the Government Order dated 27.05.2025 is strictly complied with while the Chief Medical Officer proposes to make engagement, may be on contract basis, of health workers in the Health Department of the district. It is further clarified that in the event the Chief
Medical Officer has made previously appointments despite the issuance of Government Order dated 27.05.2025 ignoring the claims of corona warriors who have been enlisted in the health department as such, the District Magistrate shall be ensuring necessary corrections so that the Government
Order dated 27.05.2025 stands complied with in its letter and spirit. With the aforesaid observations and directions, this petition stands disposed of.
