Neutral Citation No. - 2025:AHC:134639 Court No. - 4 Case :- WRIT - A No. - 11357 of 2025 Petitioner :- Saurabh Kumar Respondent :- State of U.P. and Another Counsel for Petitioner :- Sunil Kumar Yadav,Yashpal Yadav Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J.
1. Heard Sri Sunil Kumar Yadav, learned counsel for the petitioner and learned Standing Counsel for the State respondents.
2. By means of this petition filed under Article 226 of the Constitution, petitioner wants production of answer sheet (OMR sheet) of the petitioner bearing Roll No.- 14129206177 in connection with the written test held for the purposes of selection of the Head Operator in Radio Cadre service of the respondent – police establishment.
3. Learned counsel for the petitioner submits that as per his assessment he had obtained more marks to the last cut off in the select list and hence he has a fair chance to succeed if OMR sheet is produced.
4. Upon a pointed query being made that what is the basis for which such ground has been raised in the writ petition and whether he has brought the model answer key on record, learned counsel for the petitioner submits that he is not in possession to the model answer key.
5. Learned Standing Counsel on the contrary submits that petitioner even in online examination mode could have taken a print out of the model answer key and candidate is also supplied with photocopy/ carbon copy of his own OMR sheet.
6. Having heard learned counsel for the respective parties and having perused the records, in my considered view, on mere allegations on affidavit in the writ petition would not count on merit to entertain a petition because for any candidate to raise a plea that he had scored better marks should have some evidence to be placed before the Court. If the petitioner is not in possession of his own OMR sheet and also not in possession of model answer
key then allegations made in the writ petition are certainly made without any basis.
7. In the circumstances, I see no justification to call for OMR sheet from the respondents in respect of the examination in question relating to the petitioner.
8. Petition fails and is, accordingly, dismissed. Order Date :- 8.8.2025 Atmesh Digitally signed by :- ATMESH KESARI High Court of Judicature at Allahabad
