JUSTICE A.GUNESHWAR SHARMA 28.3.2025 Heard Mr.M.Hemchandra, learned senior counsel assisted by Mr.M.Rendy, learned counsel for the petitioner and Mr.S.Niranjan, learned Government Advocate for the respondents. [2] Mr.Hemchandra, learned senior counsel for the petitioner submits that the petitioner, who is an association of Moreh Imphal Jeep & Tata Sumo Taxi Service, earlier submitted a representation dated 16.4.2023 to the Principal Secretary/Commissioner/ Secretary (Home), Government of Manipur for giving compensation for burning down of two vehicles of its members being Tata Sumo bearing Regd No.MN 06 L-0235 and Bolero vehicle, Regd No.MN04 A 4461 between Bongyang and Thamnapokpi on Imphal Moreh Road on 11.7.2012 by some unknown persons. Vide order dated 6.7.2023 passed by this Court in WP(C) No.487/2023, the D.C, Tengnoupal, was directed to dispose of the representation dated 16.4.2023 made by the petitioner. Thereafter, vide order dated 25.10.2024 passed by the D.C., Tengnoupal, representation of the petitioner association was rejected as not maintainable. Cont (C) Case No.16 of 2024 filed by the petitioner was dismissed as withdrawn on 8.11.2024 as direction of Court dated 6.7.2023 has already been complied. Thereafter, petitioner approached this Court by way of WP(C) No.100 of 2025 stating that the representation dated 16.4.2023 was addressed to the Administrative Secretary, Home and the same was wrongly rejected by the D.C, Tengnoupal. Vide order dated 5.2.2025 this Court observed that since representation has already been disposed of by the D.C, Tengnoupal as directed in order dated 6.7.2023, no cause survived for disposing the representation dated 16.4.2023. However, petitioner was granted liberty to approach the appropriate forum for agitating their grievance. [3] Mr.M.Hemchandra, learned senior counsel for the petitioner submits that the appropriate authority for giving relief to the petitioner is the Director, Relief and Rehabilitation, Manipur and as permitted by this Court, petitioner submitted representation dated 13.2.2025 to the Principal Secretary/ Commissioner/ Secretary (Home), Government of Manipur and to the Director, Relief and Rehabilitation, Manipur for consideration for payment of compensation for the two vehicles burnt down by unknown persons. Learned senior counsel submits that the writ petition maybe disposed of by directing respondent No.2 to pass speaking order to the representation dated 13.2.2025, as per Rule, within a stipulated time. [4] Mr.S.Niranjan, learned Government Advocate has no objection in issuing any innocuous order in terms of fresh representation dated 13.2.2025. [5] This Court has perused the materials on record and considered the submissions made at the Bar. The writ petition is disposed of by directing respondent No.2, The Director, Relief & Rehabilitation, Manipur to dispose of the representation dated 13.2.2025 submitted by the petitioner by a speaking order, as per Rule, within a period of two months from the date of receipt of a copy of this order. With this observation, the writ petition is disposed of. [6] It is made clear that this Court does not express any opinion on the merit of the case.
