Neutral Citation No. - 2025:AHC:33880 Court No. - 4 Case :- WRIT - A No. - 526 of 2025 Petitioner :- Umesh Kumar And 6 Others Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Mohammad Ali Ausaf Counsel for Respondent :- C.S.C.,Siddharth Singhal Hon'ble Ajit Kumar,J. Heard learned counsel for the parties. By means of present petition filed under Article 226 of the Constitution, petitioners are seeking promotion from the post of Assistant Accountant to the post of Accountant for which according to the petitioner they are fully eligible in view of the provisions contained under Rule 7(2) of Part III of U.P. Government Department Subordinate Accounts Cadre (Non-Gazetted) Service Rules, 2014. It transpires from the record that petitioners have approached the competent authority in the matter by making representation dated 23.7.2024 but that has remained unconsidered till date. Per contra, it is argued by learned Standing Counsel that petitioners since are seeking promotion on the basis that they are eligible to be promoted then each candidates' candidature has to be considered separately and accordingly they should make separate representations. In view of aforesaid, this petition stands disposed of with direction to each of the petitioners to move individual separate applications before the competent authority, namely respondent no. 2 within a period of two weeks' from today, and in the event petitioners' move separate individual applications, respondent no. 2 will consider the representations of the petitioners on the basis of eligibility of each candidate qua vacancy, if any, available and dispose of the same within a further period of three months, by means of reasoned and speaking order.
