This is Fourth bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to applicant, who has been arrested in connection with Crime No.298/2023, registered at PS - Newai, District-Durg, C.G, for commission of offence punishable under Sections 147, 148, 294, 506B, 323, 324, 307, 302 of BNSS and Section 25, 27 2 of Arms Act. Earlier applicant had preferred first bail application before this Court which is registered as MCRC No. 6631 of 2024 vide order dated 16.10.2024, which was dismissed as withdrawn and Hon’ble Court was directed to expedite the trial. Thereafter, applicant filed Second Bail application MCRC No. 253 of 2025 vide order dated 13.01.2025, which is withdraw by the learned counsel for the applicant with direction to expedite the trial and to take all necessary steps and measures for causing presence of prosecution witnesses. And earlier the applicant filed bail application before the Court of Additional Sessions Judge (FTC) Durg, C.G. which has been rejected vide order dated 29.05.2024 in B.A. No. 626 of 2024 and same has also been rejected. 2. Case of prosecution, in brief, is that on 24.04.2023 applicant along with other co-accused persons have assaulted the Raman Yadv @ Pappu by means of hands, fists, club and knife. He was taken to hospital where he succumbed to injury. Merg was reported on the basis of the evidence of eyewitnesses.. After merg inquiry, aforementioned crime was registered and applicant was arrested on 05.01.2024. 3. Learned counsel for the applicant submits that applicant has been falsely implicated in this case, he has not committed any offence as alleged against him. He further submits that there is some hot talk with the point of quarrel in between them but due to wrong intention the complainant lodged the report against the applicant. He further submits that applicant has no 3 intention to injure upon the complainant and He also submits that applicant is in jail since 05.01.2024, conclusion of trial may take some time, hence, applicant may be released on bail. 4. Per contra, learned State Counsel opposes the bail application and submits that there are eyewitnesses to the incident and the statement of Vishal Yadav under Section 164 of Cr.P.C. is also recorded in which applicant is named to be one of the assailant by means of knife and he has one previous criminal antecedent, in which he has been acquitted from the alleged charges, looking to the overt act application may be reject. 5. Heard learned counsel for the parties and perused the records. 6. Considering facts of the case, looking to the seriousness of allegations, involvement of the applicant in offence, submission of learned counsel for the parties, material available on record, without commenting anything on merits, I am not inclined to allow this bail application. 7. Accordingly, bail application is rejected. Certified copy as per rules.
