(Oral) Applicant is in judicial custody in Case Crime No.17 of 2020, under Sections 302, 201 read with Section 34 IPC, Police Station Kaladhungi, District Nainital. He has sought his release on bail. 2. Heard learned counsel for the parties and perused. 3. This is the fourth bail application. The first bail application, being BA1 No.2532 of 2021, was rejected on 12.07.2022. The second bail application, being BA2 No.179 of 2023, was also rejected on 15.09.2023. The third bail application, being BA3 No.43 of 2024, was dismissed as withdrawn on 12.06.2024. 4. It is argued by learned counsel for the applicant that co-accused, Kuldeep Singh, who has identical role, has already been granted bail by this Court. 2 5. This fact is admitted by learned State Counsel. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
