JUSTICE NIRZAR S. DESAI Date : 15/12/2025 ORAL ORDER 1. By way of the present petition, the petitioner has prayed for the following reliefs:- “a. YOUR LORDSHIPS be pleased to issue a writ of mandamus or a writ in the nature of mandamus or any other appropriate writ, order or direction to command the respondent for taking action as per the representation made by the present petitioner at (Annexure-A”) to this petition for calculating all his service benefits, in the interest of justice; b. Be pleased to award the cost of this petition; c. Pass any such other and/or further orders that may be thought just and proper, in the facts and circumstances of the present case.” C/SCA/7865/2024 ORDER DATED: 15/12/2025 2. At the outset, learned advocate Ms. Alvera Kachra, appearing for learned advocate Mr. Samrat Upadhyay on behalf of the petitioner, submitted that the present petition is covered by the order dated 10.11.2025 passed by this Court. 3. In view of the above, the matter was taken up, and even learned Advocate Mr. Dipak Dave, appearing for the respondents, could not dispute the fact that the present petition is covered by the order dated 10.11.2025 passed by this Court in Special Civil Application No.7858 of 2024 and allied matters in case of Rajakbhai Mamadbhai Juneja Versus Pachim Gujarat Vij Company Limited and Another. Hence, the following order is passed :- I have considered the fact that the petitioner is seeking a direction to decide the representation dated 21.9.2023 made by the petitioner to the Managing Director of Paschim Gujarat Vij Company Limited which has not been decided till date according to learned advocate for the petitioner and learned advocate Mr. Dipak R. Dave appearing for the C/SCA/7865/2024 ORDER DATED: 15/12/2025 respondents could not dispute the aforesaid fact. However, learned advocate Mr. Dipak Dave states that appropriate authority to decide the pending representation of the petitioner would be General Manager (HR) / Additional General Manager (HR) and though they are not made parties before this Court as Managing Director is a party, learned advocate Mr. Dipak R. Dave has assured the Court that no technical objections about non-joining of General Manager (HR) / Additional General Manager (HR) as parties would be taken by the respondents. Accordingly, the following order is passed :- (i) The General Manager (HR) / Additional General Manager (HR) of the Paschim Gujarat Vij Company Limited is hereby directed to decide the pending representations of the petitioner (annexed at Annexure A to the petition) within a period of six weeks from today by passing a reasoned order, in accordance with law and communicate the decision thereof to the petitioner by way of Speed Post. 4. With the aforesaid order, without examining the C/SCA/7865/2024 ORDER DATED: 15/12/2025 merits of the matter, the present petition stands disposed of. Notice is discharged. No order as to costs.
