Heard learned counsel for the applicant and learned AGA for the State-respondent. 2. This application has been filed by applicant for quashing the entire proceedings of Complaint Case No.4035 of 2019, Ravindra Vs. Surendra Dutt, under Section 138 Negotiable Instrument Act, Police Station Baghpat, District Baghpat as well as summoning order dated 17.11.2020 and 16.12.2022 passed by Chief Judicial Magistrate, Baghpat. 3. It is submitted by learned counsel for the applicant that the applicant may be permitted to apply before the trial court for compounding of the offence in terms of the law laid down by Supreme Court in the case of Damodar S. Prabhu Vs. Sayed Babala H., 2010 (5) SCC 663. He submits that the trial court be directed to consider the same in accordance with law. 4. Considering the facts and circumstances of the case and the argument raised by learned counsel for the applicant, this application is disposed of with liberty to the applicant to apply before the court concerned for compounding of the offence in terms of the law laid down by Supreme Court in the case of Versus Counsel for Applicant(s) : A.C.Srivastava, Subham Singh Counsel for Opposite Party(s) : G.A. Surendra Dutt Kaushik .....Applicant(s) State of U.P. and Another .....Opposite Party(s) Damodar S. Prabhu (supra).
