A.No.2138 of 2025 has been filed for grant an order of ad-interim direction to the respondent to appoint Government Surveyor to conduct a comprehensive survey and measure the applicant’s plot Nos.5 & 12 in Survey No.181/1 situate at Ayanambakkam Village, Poonamallee Taluk (Previously https://www.mhc.tn.gov.in/judis A No. 2138 of 2025 __________ Page3 of 5 anattur Taluk), Tiruvallur District, together with Mr.C.Kandasamy Naidu Trust property measuring an extent of 1 Acre 92 cents comprised in Survey No.175/4 situated at Ayanambakkam Village, Poonamallee Taluk, Tiruvallur district in the presence of concerned parties pursuant to the representation dated 11.04.2025 and submit a report before this Court. 3. Application No.435 of 2025 has been filed to grant an order of ad- interim injunction forbearing the Respondent, their men and agents or anyone acting on their behalf from entering upon, interfering/disturbing the peaceful possession and enjoyment of the Applicant’s Plot Nos.5 and 12 in Survey No.181/1 situated at Ayanambakkam Village, Ponamallee Taluk Tiruvallur District including erecting of concrete fencing pillars/poles in the said property. 4. Pertinently, in pursuance to the auction notification dated 16.04.2025, auction was conducted on 23.04.2025 and successful bidder deposited the amount and an agreement was entered into between the successful bidder and learned AG&OT. The subject property has been leased out. 5. The grievance of the applicant is that she has purchased the Housing Plot No.5 measuring an extent of 1811 sq.ft and Plot No.12 measuring an extent 1841 sq.ft. comprised in S.No.181/1 in the lay out formed by Chennai Metropolitan Housing Society Limited. 6. Learned counsel for the appellant would submit that certain discrepancies are identified in respect of the boundary line on account of the fencing done by the AG&OT pursuant to the direction of this Court, while identifying the property of Shri.C.Kandasamy Naidu Trust. https://www.mhc.tn.gov.in/judis A No. 2138 of 2025 __________ Page4 of 5 7. The boundary dispute as raised by the applicant cannot be adjudicated in the present application. 8. Learned AG&OT states that there is no dispute in respect of the boundary line and the AG&OT has already fenced the boundaries, conducted public auction and entered into a lease agreement with the successful bidder. That being the submission made on behalf of the learned AG&OT, if at all the applicant has got any doubt regarding the boundary in respect of the property purchased by her from the Co-operative Housing Society, it is for her to redress her remedy in the manner known to law. It is made clear that mere conduct of survey by the Surveyor of the Government Department would not be a ground to claim title or otherwise. The revenue authorities, survey authorities or the Tahsildars, empowered to grant patta are incompetent to adjudicate the disputed issue of civil nature i.e., title/ownership. All such disputed issues of civil nature is to be adjudicated by competent civil court of law. Therefore, the ground raised by the applicant regarding discrepancy in the boundary line in respect of the property purchased by the applicant would fall beyond the scope of the present proceedings.
