(Petitioner Is Distt Jail Baran) ----Accused-Applicant Versus State of Rajasthan, Through PP ----Respondent For Applicant : Mr. Ali Mohammed Khan, Adv. For Respondent : Mr. Vivek Sharma, Addl.G.A. with Ms. Arti Sharma, Dy.G.A. HON'BLE MR. JUSTICE ASHUTOSH KUMAR Order 24/04/2025 1. The present bail application has been filed by the accused- applicant under Section 483 of the B.N.S.S, 2023 against the order dated 18.01.2025 passed by learned Special Judge, Narcotic Drugs and Psychotropic Substances Cases, Baran, District Baran in Bail Application No.20/2025 arising out of FIR No.16/2025, registered at Police Station Anta, District Baran for the offences punishable under Section 8/21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as the 'Act of 1985') by which the bail application of the accused- applicant under Section 483 of B.N.S.S., 2023 has been dismissed. 2. Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this case. Learned counsel also submits that the charge levelled against the [2025:RJ-JP:17276] (2 of 3) [CRLMB-2798/2025] accused-applicant is that 6 grams 92 miligrams of 'smack' has been recovered from his possession, which is just above small quantity. Learned counsel further submits that in this matter, charge-sheet has been filed. 3. Learned counsel for the accused-applicant argues that learned trial Court has rejected the bail application of the accused- applicant under Section 483 of B.N.S.S., 2023 on the ground that six other cases for the offences punishable under the Act of 1985 have been registered against the accused-applicant, however, the accused-applicant has been acquitted in two of such cases. 4. Learned counsel for the accused-applicant contends that the accused-applicant was arrested on 08.01.2025 and since then, he is behind the bars, trial will take long time to conclude, therefore, the accused-applicant be granted benefit of bail. 5. Learned Deputy Government Advocate along with learned Additional Government Advocate vehemently oppose this bail application on the ground that six other cases of similar nature have been registered against the accused-applicant. 6. Heard learned counsel for the parties and also perused the material available on record. 7. Admittedly, the contraband recovered from the possession of the accused-applicant is just above small quantity and the charge- sheet has already been filed. 8. Having regard to the facts and circumstances of the case, and considering the fact that the applicant is in judicial custody since 08.01.2025 and also considering the fact that the trial will take long time to conclude, but without expressing any opinion on [2025:RJ-JP:17276] (3 of 3) [CRLMB-2798/2025] the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the applicant. 9. Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicant Sonu S/o Shri Govind Lal, arrested in connection with FIR No.16/2025, registered at Police Station Anta, District Baran shall be released on bail; provided he furnishes personal bond in the sum of Rs.1,00,000/- and two solvent attested sureties of Rs.50,000/- to the satisfaction of the trial Court. Applicant shall be required to appear before that Court on all dates of hearing and as and when called upon to do so. (ASHUTOSH KUMAR),J AARZOO ARORA /101
