Neutral Citation No. - 2025:AHC:135426 Court No. - 4 Case :- WRIT - A No. - 11376 of 2025 Petitioner :- Mukesh Kumar Respondent :- The State Of U.P. And 3 Others Counsel for Petitioner :- Prashant Kumar Tripathi Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. By means of present petition filed under Article 226 of the Constitution, petitioner has assailed the order of transfer dated 15th July, 2025 on twin grounds; firstly he has been transferred within eight months of the previous posting; and secondly his father is 90 years old ailing person . Learned Standing Counsel on the contrary submits that petitioner has been transferred in public interest, and so therefore, he could not have any grievance, inasmuch as, respondents authorities in their discretion can transfer the employee in public interest at any point of time. In the given facts and circumstances of the case, when the petitioner has been transferred within a period of eight months of his last posting, it can be considered not a mature case, within the transfer policy to consider his transfer. However, since petitioner has been relieved pursuant to order of transfer dated 15th July, 2025, I consider it appropriate for the petitioner to make representation within a period of two weeks from today and if he makes representation, the same shall be considered and disposed of within a further period of four weeks by means of reasoned and speaking order considering the transfer policy in question. In view of aforesaid, this petition stands disposed of. Order Date :- 8.8.2025 Sanjeev Digitally signed by :- SANJEEV RANJAN High Court of Judicature at Allahabad
