The present petition has been filed with the following prayer: "(i) Issue a writ, order or direction in the nature of Mandamus commanding/directing the Respondent Authorities to release the balance Admitted amount of Rs. 28,37,651/- unpaid towards the contract work done under the contract Bond No. 27/SE/2012-13 dated 29.03.2013 for Restoration of Pucca Road Km. 0.00 to 2.800 of left afflex bund of Ramganga Barrage Hereoli with interest thereon." 2. Learned Standing Counsel has placed on record the instructions received from Executive Engineer, Irrigation Division, Moradabad in which it is stated that a proposal has been sent to the State Government for allocation of necessary funds and it includes the claim of the petitioner for sum of Rs. 28,37,651/-. It is stated that as soon as the necessary fund is allotted the payment of dues of the petitioner shall be made. 3. Having regard to the fact that the claim of the petitioner is admitted, we dispose of the instant petition with direction to respondents no. 1, 3, 4 and 5 to ensure that payment of dues of the petitioner is made within four weeks from the date of communication of the instant order.
