PUBLIC PROSECUTOR The Court made the following order: The learned counsel for the Petitioner/Accused No.4 submits that the present criminal petition is filed seeking to quash the order passed by the II Additional District and Sessions Judge, Kadapa at Proddatur, in Crl.M.P.No.32 of 2025 in Crl.M.P.No.529 of 2022 in Crime No.240 of 2022. 2. The petitioner was granted anticipatory bail in Crime No.240 of 2022 on 09.01.2023. The learned II Additional District and Sessions Judge, Kadapa at Proddatur, directed the petitioner to surrender before the learned Judicial Magistrate of I Class, Mydukur, within 15 days from the date of the order. Upon his surrender, the learned Judicial 2 Magistrate of I Class, Mydukur, was directed to release the petitioner on bail upon his executing a personal bond of Rs.20,000/- with two sureties for the like sum and further directed the petitioner to appear before the Investigating Officer on every Sunday, between 10.00 AM to 5.00 PM, till the filing of the charge sheet. 3. The learned counsel for the petitioner/Accused No.4 submits that the petitioner has been diligently complying with the conditions for the last two years and that the investigation is still pending. The petitioner sought relaxation of the condition of appearing before the Investigating Officer every Sunday from 10.00 AM to 5.00 PM by filing Crl.M.P.No.32 of 2025, which was dismissed by the learned II Additional District and Sessions Judge, Kadapa at Proddatur, on 06.02.2025, on the ground that the charge sheet is yet to be filed. 4. The learned Public Prosecutor appearing for the respondents does not dispute the submission of the learned counsel for the petitioner/Accused No.4 insofar as complying with the directions of the learned Sessions Judge is concerned. 5. Considering that the time for filing the charge sheet has passed and that the investigation is still pending, this court is inclined to allow the present criminal petition. The condition imposed by the learned II Additional District and Sessions Judge, Kadapa at Proddatur, in 3 Crl.M.P.No.529 of 2022, regarding the appearance of the petitioner before the Investigating Officer every Sunday, between 10.00 AM to 5.00 PM, till filing of the charge sheet, is here hereby relaxed. 6. Accordingly, the criminal petition is allowed.
