Present petition has been filed under Section 439 of Cr.P.C., 1973 seeking grant of regular bail to the petitioner in FIR No.17 dated 20.01.2021 under Sections 21/22/61/85 of the NDPS Act, 1985 registered at Police Station Sadar Patiala, District Patiala. 2. On 20.11.2023, the following order was passed:- “Contends that petitioner is in custody since 20.01.2021; charges were framed on 18.11.2021, but till date, out of total 07 prosecution witnesses, only 02 have been examined. Also submits that co-accused Gurwinder Singh @ Guri @ Rana and Karan Batta have already been granted the concession of bail pending trial by the Co-ordinate Bench vide orders dated 31.07.2023 and 31.08.2023, respectively. Learned State counsel seeks time to verify the above factual position. Posted for 15.01.2024. In the meanwhile, petitioner be released on interim bail in the present case till the next date of hearing on his furnishing adequate bail and surety bonds subject to the satisfaction of learned trial Court/CJM/Duty Magistrate concerned.” 3. Learned counsel appearing for the petitioner has submitted that the petitioner is regularly appearing before the trial Court and is facing trial in NAVEEN NAGPAL 2025.07.30 18:05 I attest to the accuracy and authenticity of this order/judgment HIgh Court Chandigarh CRM-M-45858-2023 P a g e | 2 accordance with law. He has further iterated that the case is now fixed for defence evidence on 20.08.2025 and there is no allegation for any misuse of concession of interim bail granted to the petitioner. 4. Learned Stated counsel has opposed the grant of regular bail to the petitioner, but has not disputed the fact that the petitioner has not misused the concession of interim bail extended to him and the trial is now fixed for defence evidence on 20.08.2025. 5. In view of above, the present petition is allowed and the interim bail granted to the petitioner vide order dated 20.11.2023 passed earlier by this Court is hereby confirmed, subject to the following conditions:- (i) The petitioner shall not mis-use the liberty granted. (ii) The petitioner shall not tamper with any evidence, oral or documentary, during the trial. (iii) The petitioner shall not absent himself on any date before the trial. (iv) The petitioner shall not commit any offence while on bail. (v) The petitioner shall deposit his passport, if any, with the trial Court. (vi) The petitioner shall give his cellphone number to the Investigating Officer/SHO of concerned Police Station and shall not change his cell-phone number without prior permission of the trial Court/Illaqa Magistrate. (vii) The petitioner shall not in any manner try to delay the trial. 6. In case of breach of any of the aforesaid conditions and those which may be imposed by concerned trial Court/Duty Magistrate or upon showing any other sufficient cause, the State shall be at liberty to move cancellation of bail of the petitioner. 7.
