1. The case of the petitioner is that his date of birth is 25.03.2006. He has applied for correction of date of birth in his Aadhaar certificate, inasmuch as therein, the date of birth has been wrongly shown as 30.12.2008. It is also the case of the petitioner that similar mistake in the Aadhaar certificate of his twin brother, namely Satyam Singh, has already been corrected. The petitioner has prayed for a writ of mandamus commanding the respondent authorities to carry out the required correction.
2. Shri Rajesh Kumar Vidyarthi, Advocate has placed on record the instructions received from the Deputy Director, Unique Identification Authority of India, Government of India. The stand taken therein is that for any person between 0- 18 years of age seeking correction in date of birth, a birth certificate issued by authorized authority of the respective state is a mandatory requirement. As the petitioner is below 18 years of age as per the date of birth recorded in the Aadhaar certificate, therefore, he is required to produce the birth certificate. However, the petitioner has not produced the same so far. In paragraph 4 of the instructions, it is stated that the petitioner has to visit the nearest Aadhaar center and update his date of birth with birth certificate.
3. Shri J.S. Pandey, learned counsel for the petitioner, having regard to the said stand, submits that the petitioner will complete the required formalities and prays that the respondents be directed to act expeditiously.
4. Accordingly, we dispose of the instant petition with liberty to the petitioner to visit the nearest Aadhaar center and update his date of birth with birth certificate and in which event, the respondents will ensure that required action is taken in the matter within next one week.
