Order on Board 19/03/2025
1. By way of this petition, the petitioner has prayed for following reliefs:-
“10.1 That the Hon'ble Court may kindly be pleased to issue a writ of mandamus or any other appropriate writ calling for the records from the respondents authorities with respect to the lands where the petitioners have been residing, in the interest of justice. 10.2 That the Hon'ble Court may kindly be pleased to issue a writ of mandamus or any other appropriate writ directing demarcation of the land where petitioners are residing to ascertain the nature of the land and submit report before the Hon'ble Court for due appreciation of the claim of the petitioner on the land, in the interest of justice. 10.3 That the Hon'ble Court may kindly be pleased to issue a writ of mandamus or any other appropriate writ setting aside impugned notices dated 17.01.2025 (annexure P/5) in the Interest of justice. 10.4 That the Hon'ble Court may kindly be pleased to issue a writ of mandamus or any other appropriate writ directing the respondents to consider the eligibility and
7 claim of the petitioner for grant of patta (pattadhriti adhikar) under the ACT and RULE of 2023..... Alternatively, 10.5 That the Hon'ble Court may kindly be pleased to issue a writ of mandamus or any other appropriate writ directing the respondents to rehabilitate and grant allotment of houses by issuance of proper allotement letter under the PMAY preferablely in the PMAY houses closer to the present dwelling of the petitioners, in the interest of justice 10.6 That, the Hon'ble Court may kindly be pleased to pass any other order considering the special facts and circumstances of this case.”
2. By the present writ petition, the petitioners are questioning the notice dated 17/01/2025 passed by Divisional Forest Officer, Forest Division Ambikapur, District Surguja by which the petitioners are directed to remove the alleged encroachment from the forest land.
3. Learned counsel for the petitioners after arguing for some time submits that in identical petition order has been passed by the Co-ordinate Bench of this Court in WPC No. 452/2025 (Ziyauul Huque Ansari & Ors. Vs. State of Chhattisgarh & Ors.).
4. On the other hand, learned counsel for the State submits that the

order which has been passed in WPC No. 452/2025 (Ziyauul Huque Ansari & Ors. Vs. State of Chhattisgarh & Ors.) dated 20.01.2025 in which the petitioners were granted liberty to approach before the concerned DFO for redressal of their grievances in respect of allotment of their land.
5. I have heard learned counsel for the parties and perused the material available on record.
6. Considering the facts and circumstances of the case, all the petitioners are directed to approach before he concerned DFO on or before 7th April, 2025 and, in turn, the DFO is directed to examine each and every case of the petitioners and to pass appropriate orders within a period of 10 days from the date of filing of the application.
7. It is made clear that till then status quo, in respect of the land in question, as it exists today, be maintained by both the parties.
8. The petitioners are always having liberty to approach this Court in case exigency arises.
9. With this observation and direction, the writ petition stands
