Thereafter, a civil appeal No. 02 of 2024 was filed which was also dismissed on 26.04.2024. Against both the judgments and decree present matter under Article 227 of Constitution of India has been preferred by petitioner. 2. No writ petition lies against the judgment and decree passed by civil court and only second appeal lies under Section 100 CPC. 3. Writ petition is dismissed on the ground of alternative remedy leaving it open to petitioner to file second appeal, if so advised. 4. Office to return certified copies of both the judgments to petitioner's counsel within 48 hours.
