The grievance of the petitioner is that by the order impugned she has been promoted to the post of Assistant Teacher by giving posting in a place which is a durgam area. 4. Learned counsel for the petitioner submits that the petitioner is a disabled person ,i.e, 40% visual disability+15% ortho/physical disability in total 54% disability, in reference to which disability certificate is also annexed as Annexure 6. 5. Prima facie, the grievance of the petitioner appears to be genuine since she is suffering from 54% disability, in such an eventuality the respondents, being employer, should consider the personal hardship of the petitioner sympathetically. In reference to this, the petitioner already submitted a representation to the Addl. Director (Secondary Education) Kumaun Division, Nainital on 15.10.2024 which has yet not been decided. 6. In view of the observations as made above, the Addl. Director (Secondary Education)-respondent no. 2 is directed to decide the representation of the petitioner dated 15.10.2024 by a reasoned and speaking order, after taking into consideration that the petitioner is 54% disabled. This entire exercise for taking decision on the 2025:UHC:474 representation of the petitioner shall be completed within one month from the date of production of certified copy of this order. 7.
