ORAL ORDER
This petition is filed by accused No.2 (as per FIR) under Section 483 of BNSS praying to grant bail in Cr.No.73/2025 of Virajpet Town Police Station registered for offences under Section 109(1), 115(2), 310(2) and 190 of BNS.
2. Heard learned counsel for petitioner and learned HCGP for respondent/State.
3. Learned Counsel for petitioner would contend that accused Nos.2, 4 and 5 have been granted bail by the Sessions Court. The petitioner is a student studying in BCA and his exams are commencing from 24.11.2025. The

alleged incident has taken place in a sudden quarrel. The petitioner and the injured persons are friends. The petitioner is aged 19 years and he is having no criminal antecedents. The injured have been discharged from the hospital and they are out of danger. The petitioner is ready to co-operate for further investigation and abide by any conditions to be imposed by this Court. With this, he prayed to allow the petition.
4. Per contra, learned HCGP would contend that serious overt acts are alleged against this petitioner assaulting the injured with knife and causing grievous injuries. The injured have sustained grievous injuries on their vital part. The investigation is in progress. With this, she prayed to reject the petition.
5. Having heard the learned counsels, the Court has perused the FIR, complaint, remand application and other materials placed on record.

6. Petitioner is arrayed as accused No.2 in the FIR and as accused No.1 in the remand application. The overt act alleged against this petitioner is assaulting complainant, Karthik and Darshan. The incident took place in respect of girl by name Pooja. The injured who sustained grievous injuries have been discharged from the hospital and they are out of danger. The petitioner is in custody since 13.09.2025 and therefore, he is not required for any custodial interrogation. There are no criminal antecedents of the petitioner. The petitioner is a student of BCA and he has to appear for examination commencing from 24.11.2025. Considering the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following:
ORDER
The petition is allowed. The petitioner is granted bail in Crime No.73/2025 of Virajpet Town Police Station subject to following conditions:

1. The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety for the likesum to the satisfaction of the jurisdictional Court.
2. The petitioner shall not tamper the prosecution witnesses either directly or indirectly.
3. The petitioner shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
4. The petitioner shall co-operate with I.O. for further investigation.
5. The petitioner shall not commit any offence. If the petitioner is found having committed any offence, the prosecution is at liberty to seek cancellation of the bail granted to him.
