Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has, inter alia, prayed for the following relief:- “i That the respondent may very kindly be directed to allot the hostel to the petitioner under EWSs category with immediate effect.” 2. It is averred in the writ petition that on 23.04.2024, the petitioner applied for admission in M.Ed. Course with the respondent-University, under the category of Economically Weaker Section. The entrance test was conducted on 25.05.2024. The petitioner was admitted under General EWS against PWD Quota. In the process of allotment of hostel, on 03.12.2024, the petitioner 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:9036 applied for hostel facility. When the list of hostel allotment was released, hostels were not allotted to the students belonging to the Economical Weaker Section Category. Feeling aggrieved, the petitioner, filed a representation. The petitioner was informed by the University that he was admitted as a General Category candidate against the vacant seat of PWD Category. The petitioner again made a representation to the Vice Chancellor, feeling aggrieved by non- allotment of the seat under EWS Category and as no action was taken by University, hence this petition. 3. On the last date of hearing, this Court directed learned counsel for the respondent to produce the record relating to the admission form of the petitioner. 4. In terms of the Instructions which have been imparted by the Chairman, Department of Education, no seat under EWS Category was reserved in M.Ed programme as per the Roster attached and the petitioner was rather admitted as a General Category candidate in order of merit, against two vacant seats of PWD Category due to non-availability of PWD candidates. 5. In the light of the fact that there was no seat reserved under EWS Category in the M.Ed programme in terms of the Roster and that the petitioner was admitted against the seat belonging to PWD Category due to non-availability of PWD candidate as a General 3 2025:HHC:9036 Category candidate, it is not understood as to how the petitioner can claim hostel facility under the category of EWS. 6. In fact, the petitioner has tried to mislead the Court by mentioning in Para-5 of the writ petition that he was admitted in the M.Ed Course under General EWS Category, though against a post of PWD Quota. This Court deprecates this sharp practice of making incorrect averments in the writ petition. However, this Court is not taking any further action in the matter in the light of the fact that the petitioner is student. 7. Be that as it may, as the petitioner, who has been admitted as a General Category candidate, has to seek hostel facility under the said category, i.e. the Category in which he has been admitted and further, in the light of the fact there was no seat reserved for EWS Category in the M.Ed programme in which the petitioner was admitted, as this Court does not finds any merit in the present petition, the same is dismissed.
