Neutral Citation No. - 2025:AHC:139544 Court No. - 70 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 27314 of 2025 Applicant :- Soni Singh Opposite Party :- State of U.P. Counsel for Applicant :- Mohd Naushad,Syed Irfan Ali Counsel for Opposite Party :- Ashutosh Kumar Pandey,G.A.,Vinod Singh Hon'ble Dr. Gautam Chowdhary,J.
1. Heard learned counsel for the applicant, learned A.G.A. for the State as well as learned counsel for the informant and perused the material brought on record.
2. Learned counsel for the applicant submits that the applicant is named along with other two accused. The allegation is that all the accused on the pretext of sell a piece of of land had taken about one crore rupees from the informant and neither they executed the sale deed for the said land and nor they returned their entire money.
Learned counsel further submits that the informant is the cousin brother of co-accused, Padmakar Maurya, and the present applicant is the wife of Padmakar Maurya. The alleged transaction was done between the informant and the applicant's husband. She has no concern with the alleged amount. The receipts showing that applicant had received some cash from the informant are also doubtful as there is no F.S.L. report of such receipts, thus, it has been argued that there is no evidence on record that the informant had ever given any money to the applicant. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned. It has also been assured on behalf of the applicant that she is ready to cooperate with the process of law and shall faithfully make herself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon her. The applicant is in jail since 14.07.2025, with no criminal history. 3. Learned A.G.A. for the State as well well as learned counsel for the informant have opposed the prayer for bail. 4. Considering the overall facts and circumstances, the nature of allegations, the gravity of offence and without expressing any opinion on merits, this Court finds it to be a fit case for bail. Accordingly, the bail application stands allowed. 5. Let the applicant-Soni Singh, be enlarged on bail in Case Crime No. 119 of 2024, under Sections 406, 420, 504, 506 I.P.C., Police Station- Ghosi, District- Mau, on executing a personal bond and

v) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade such person from disclosing facts to the Court or to any police officer or tamper with the evidence. 6. In case of default of any of the conditions enumerated above, the informant would be free to move an application for cancellation of bail before this Court.
