The petitioners are before this Court under Section 528 of BNSS, 2023 with a prayer to quash the entire proceedings in Crl.Misc. No.82 of 2018, pending before the Court of JMFC-II, Belagavi, filed by the respondent under Section 12(1) of the Protection of Women from Domestic Violence Act, 2005. 2. Heard the learned counsel for the petitioner. 3. The respondent herein has initiated proceedings against the petitioners herein before the Jurisdictional Court of Magistrate under Section 12 of the Protection of Women from Domestic Violence Act, 2005, which is numbered as - 3 - HC-KAR NC: 2025:KHC-D:12028 CRL.P No. 103710 of 2025 Crl.Misc. No.82/2018. The petitioners herein are the husband and in-law of the respondent. 4. The Order Sheet of the trial Court in Crl.Misc. No.82 of 2018 would go to show that the petitioners herein have filed objections to the main petition and have contested the matter pending before the learned Magistrate. Before the learned Magistrate, the parties have already led evidence on their behalf and the matter was posted for addressing final arguments on 06.03.2025. 5. Learned counsel for the petitioners fairly submits that the final arguments on behalf of the respondent herein is already completed before the trial Court and the matter is now at the stage of addressing final arguments on behalf of the petitioners. Therefore, I am of the opinion that at this stage, this petition filed with a prayer to quash the entire proceedings in Crl. Misc. No.82 of 2018, pending before the trial Court at the stage of addressing final arguments on - 4 - HC-KAR NC: 2025:KHC-D:12028 CRL.P No. 103710 of 2025 behalf of the petitioners cannot be entertained.
