1. Mr. Avidit Noliyal, learned counsel for the applicant.
2. Mr. V.S. Pal, learned A.G.A. for the State.
3. This is the second bail application moved on behalf of the applicant seeking bail in relation to FIR dated 04.03.2025, registered as FIR No. 110 of 2025 at P.S. SIDCUL District Haridwar wherein the present applicant is implicated for the offences punishable under Sections 8/21/60 of the NDPS Act.
4. The first bail application was rejected on 19.05.2025 by a reasoned order and now the instant second bail application has been moved.
5. On perusal of the second bail application it reveals that there is no fresh ground except that the first bail application was rejected on 19.05.2025 and now two months have been expired. Apart from this, learned counsel for the applicant submits that other co-accused, namely, Dharmendra has already been enlarged on bail and the learned counsel for the State was granted time to ascertain whether other co-accused having any criminal history or not.
6. Mr. V.S. Pal, learned A.G.A. apprise to this Court that the co-accused has no previous criminal history relating to the NDPS Act. He submits that the applicant is a habitual offender in respect of the offence relating to the NDPS Act, and furthermore there is no fresh ground, therefore, second bail application is liable to the rejected.
7. After hearing the arguments of the
learned counsel for the parties and further
2025:UHC:6658 taking into consideration that there is no fresh ground in the second bail application, and, as such, the applicant does not deserve for bail.
8. Accordingly, second bail application is rejected.
