In this writ petition, the petitioner has called in question the inquiry report dated 15.04.2025 submitted by the respondent No.3, Internal Complaints Committee at Annexure-AK. 2. At the outset, the learned counsel appearing for respondents has raised a preliminary objection regarding maintainability of writ petition on the ground that the petitioner has an alternative remedy of appeal under Section 18 of the Sexual Harassment of Women at Workplace (Prevention, Prohibition And Redressal) Act, 2013 (for short ‘the Act 2013’). The applicability of the said provision has been clearly dealt by this Court in W.P.No.25263/2025. - 4 - HC-KAR NC: 2025:KHC:37416 WP No. 23303 of 2025 3. In view of the order dated 30.08.2025 passed by this Court in W.P.No.25263/2025, the writ petition is disposed of. 4. However, liberty is reserved to the petitioner to approach the appropriate legal forum. 5. If the petitioner files an appeal before the Appellate Authority within four weeks from the date of receipt of copy of this order, the Appellate Authority is directed to consider the said appeal on merits, in accordance with law, without insisting on the delay in filing the appeal.
