The instant bail application has been preferred by the applicant-Vishal Chauhan seeking bail in Case Crime No. 225 of 2024, under Sections 352, 351(2), 81 of B.N.S., Police Station Adalhat, District Mirzapur. On the matter being taken up, learned counsel for the applicant submits that so far as the present applicant is concerned, charge-sheet has been submitted against him only for the offence under Section 81 B.N.S., 2023. He further submits that the applicant may be permitted to withdraw this bail application with liberty to file fresh bail application seeking bail under Section 81 B.N.S., 2023 only. In view of the above, the instant bail application is dismissed as withdrawn with liberty to file fresh bail application with better particulars. Office is directed to return the certified copy of the documents within three days' to the counsel for the applicant after retaining the xerox copy of the same on record. Since the instant bail application has not been decided on its merit, hence, in case fresh bail application is moved by the applicant, the same shall not be treated as tied up or part heard to this Bench.
