Affidavit-of-service filed by the petitioner be kept with the record. Petitioner is aggrieved by the inaction of the police authorities and to that effect informed the Officer-in- Charge, Hoglaberia Police Station on or about 18.01.2022. The main grievance of the petitioner was in respect of the private respondents who in the banana garden by using a tractor destroyed all the fruits, to that effect petitioner complains that he had sustained a loss of Rs.2,00,000/-. Petitioner also complains that the private respondents are influential persons and are of dangerous character. Records reflected that the petitioner and the private respondents were known to each other. However since the petitioner has suffered loss as he claims and there is an attempt to encroach upon the property of the petitioner and presently the inconveniences are still 2 persisting, police authorities would ensure that there is no breach of the peace and/or tranquility and/or any untoward incident being repeated at the hands of the private respondent. Petitioner would also be at liberty to approach the Jurisdictional Civil/Criminal Court for appropriate remedies, in case the financial loss is to be recovered by them. With the aforesaid WPA 2292 of 2023 is disposed of. Report so submitted by the State be kept with the record. Copy of the report be handed over to the learned advocate appearing for the petitioner. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
