She submits, her client is aggrieved by judgment dated 28th May, 2025 of the Family Court rejecting her application made under section 26 in Hindu Marriage Act, 1955, for custody. The appeal was presented on reported delay of 27 days. Applications for condonation and exemption have been made. On query regarding section 26 providing for interim orders being made on custody she submits, the divorce proceeding is pending. As no appeal is provided from interlocutory orders under section 19 in Family Courts Act, 1984, her client will be well advised to file civil misc. writ petition. In view of aforesaid, the applications and appeal are dismissed as not maintainable. The dismissal will not prevent applicant from finding her remedy, as may be available in law.
