On perusal of the impugned notice dated 13.10.2025, it is revealed that the first respondent itself adjourned the matter since already the issue has been taken cognizance by the Hon’ble Supreme Court of India. For the very same set of allegations, FIR has been registered in crime No.1 of 2025 for the offence punishable under Section 69 of BNS. FIR was challenged before this Court in Crl.OP.No.27961 of 2024 and it was dismissed by this Court by order dated 08.11.2024. Aggrieved by the same, the petitioner preferred appeal before the Hon’ble Supreme Court of India in SLP(Crl).No.6301 of 2025 and it is pending with interim order of stay. That apart, enquiry date also expired. Therefore, nothing survives in the impugned notice issued by the first respondent. 3. Therefore, this writ petition is allowed and the impugned notice dated 13.10.2025 is set aside. However, the first respondent is at https://www.mhc.tn.gov.in/judis W.P.Crl.No.1526 of 2025 liberty to conduct enquiry subject to the result of the SLP.(Crl.) No.6301 of 2025 on the complaint lodged by the victim. Consequently, connected miscellaneous petition is closed.
