Applicant is seeking anticipatory bail in Range Case No.21/2021-2022 (Complaint Case No.14338 of 2021) under Section 9 read with Section 51 of the Wild Life (Protection) Act, 1972 and Section 26 of the Indian Forest Act, 1927, registered at Shyampur Range, Haridwar. 2. The meat of Spotted Deer was recovered from the house of the co-accused Balbir on 06.09.2021. He told on the spot that he along with Raju alias Rajendra (applicant), Ranvir and Chhajju had hunted the Spotted Deer in the forest. 3. Heard Mr. Gaurav Singh, learned counsel for the applicant and Mr. Tumul Nainwal, learned A.G.A. for the respondent. 1 2025:UHC:5553 4. Mr. Gaurav Singh, Advocate, argued that merely based on the statement of the co-accused Balbir, the applicant has been implicated. Co-accused Balbir has been granted regular bail by the Coordinate bench of this Court on 03.03.2022. Applicant does not have any criminal antecedents. He is a permanent resident of District Haridwar, therefore, there is no chance of his absconding. 5. Mr. Tumul Nainwal, A.G.A., has opposed the anticipatory bail application orally. 6. Personal liberty under Article 21 of the Constitution of India is very precious fundamental right and it should be curtailed only when it becomes imperative according to the peculiar facts and circumstances of the case. 7. Having heard the submissions of learned counsel for the parties and keeping in view of the facts and circumstances of the case, the present Application, filed for anticipatory bail, is allowed. It is directed that in the event of arrest of the applicant Raju alias Rajendra, he shall be released on anticipatory bail on executing a personal bond of Rs. 30,000/ - and two reliable sureties, each of the like amount, to the 2 2025:UHC:5553 satisfaction of the Arresting Officer, subject to the following conditions: - (i) Applicant shall attend the trial court regularly and he shall not seek any unnecessary adjournment; (ii) Applicant shall not directly or indirectly make any inducement, threat or promise to any person, acquainted with the facts of this case; (iii) Applicant shall not leave the country without the previous permission of the trial court. 8. It is clarified that if the applicant misuses or violates any of the conditions, imposed upon him, the prosecution agency will be free to move the Court for cancellation of the anticipatory bail. ___________________ ALOK KUMAR VERMA, J.
