The petitioner was initially declared “pass” with a “Grade-C” in Financial Management, 2nd semester (MB- 202). Upon applying for a review, the petitioner was subsequently downgraded to “Grade-F,” denoting a “fail” in the said paper. The petitioner now seeks a re-evaluation of the paper in question. Ms. Nandini Mitra, the learned advocate appearing on behalf of MAKAUT, submits that under the university's regulations, there is no provision for a further review of the paper. However, it has been fairly submitted that if the paper is re-evaluation by an examiner from any other university, MAKAUT will accept the outcome of that re- evaluation. 2 In light of this submission, the Financial Management paper (MB-202) shall be re-evaluated by an examiner appointed by the Indian Institute of Social Welfare and Business Management (IISWBM), affiliated with the University of Calcutta. The re-evaluation shall be completed within three weeks from the date of communication of this order. The result of the re- evaluation shall be communicated to MAKAUT within one week thereafter. Based on the result of the re-evaluation, MAKAUT shall issue a fresh marksheet to the petitioner. The petitioner is directed to add the University of Calcutta as a respondent to this writ petition and serve a copy of the writ petition upon Mr. Nilotpal Chatterjee and Mr. Satyaki Banerjee, who regularly appear on behalf of the University of Calcutta. Additionally, MAKAUT shall transmit a digital copy of the answer script to the concerned examiner engaged by IISWBM within seven days from the date of this order. Accordingly, WPA 2454 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
