ORAL JUDGMENT

Learned counsel appearing for the appellants submits that in view of the amendment to the Karnataka Civil Courts Act, 1964 and the Karnataka High Court (Amendment) Act, 2023, he is required to present the appeal before the jurisdictional District Court and therefore, seeks transfer of the case to the District Court.
2. It is further submitted that the respondents have filed execution proceedings and they are pressing the same.

Learned counsel appearing for the respondents submits that the respondents will not precipitate the execution proceedings till the jurisdictional Court considers the appellants' application for stay.
4. Said submission and the undertaking are recorded.

5. In view of the aforesaid submission, Registry is
directed to take steps to transfer this appeal to the jurisdictional District Court. The parties undertake to appear before the jurisdictional Court for first hearing on 07.01.2026, without awaiting notice.
6. The aforesaid order is passed at the joint request of the learned counsel for the appellants as well as the learned counsel for the respondents.
7. For statistical purpose, the appeal shall stand closed/disposed of.
