PUBLIC PROSECUTOR The Court made the following order: This Criminal Petition is filed under Section 528 of The Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS, 2023”) seeking to quash the proceedings initiated against the petitioner/accused in Crime.No.552 of 2024, dated 21.09.2024, on the file of SHO, P.M. Palem Police Station, Visakhapatnam, registered for the offences punishable under Sections 417, 376 of the Indian Penal Code (for short “IPC”). 2. Learned counsel for the petitioner submits that the petitioner is arrayed as accused in Crime No. 552 of 2024 of 2024 on the file of SHO, P.M. Palem Police Station, Visakhapatnam. He submits that the petitioner and the 2nd respondent are married and have submitted a marriage certificate in that regard. 3. When the matter is taken up for hearing, learned Assistant Public Prosecutor submits that the 2nd respondent has submitted a representation to the Investigation Officer communicating that she has no interest in prosecuting the case, and the Police are also taking steps to file closer report. 4. Considering the submissions of learned counsel for the petitioner and learned Assistant Public Prosecutor that the petitioner/accused and the 2nd respondent are married, no purpose would be served in continuing the investigation in Crime No.552 of 2024. As such, this Court is inclined to dispose of this criminal petition by quashing the proceedings initiated against the petitioner/accused in the above said crime. 5. Accordingly, the proceedings initiated against the petitioner/accused in Crime No.552 of 2024 on the file of SHO, P.M. Palem Police Station, Visakhapatnam, are hereby quashed. Further, the Investigation Officer shall take all necessary steps for submitting the final report by duly taking into consideration of the representation submitted by the 2nd respondent. There shall be no order as to costs.
