Learned counsel appearing for the petitioner submits that in respect of his partner Mohd Farooq Chechi and with regard to the same loan, this Court has already disposed of WP(C) No. 1351/2023 vide order dated 4th June, 2025, directing the respondents to pass a fresh order on merits only after providing an adequate opportunity of hearing to the petitioner. 02. The present case in hand is identical and, therefore, this petition too is disposed of. The impugned notice of possession is quashed. However, it is left open to the respondent Bank to pass fresh orders on merits, only after affording an adequate opportunity of hearing to the petitioner, which may include submission of documents in possession of the petitioner. 03.
