Hon'ble Manjive Shukla,J. 1.Ms.Anjali Singh, learned counsel appearing for the revisionist, at the very outset, has submitted that due to mistake, the revisionist had filed this revision though the remedy against the impugned order is by way of an appeal. She further submits that the revisionist wants to withdraw this revision with liberty to file an appeal. 2. Ms. Anjali Singh, learned counsel appearing for the revisionist has prayed that since, the period of limitation for filing of the appeal had already expired therefore, this Court may provide for condonation of delay in filing the appeal. 3. I have considered the submissions advanced by Ms. Anjali Singh, learned counsel appearing for the revisionist. 4. So far as the withdrawal of this revision by the revisionist is concerned, this Court has no objection and therefore, this revision is dismissed as withdrawn. 5. In respect of the issue of limitation, this Court is of the view that for condonation of delay in filing the appeal, the revisionist may file an application for condonation of delay along with appeal and that application would be considered by the competent court dealing with the appeal, in accordance with law. 6. The office is directed to return the certified copy of the impugned order dated 15.10.2024 to the learned counsel appearing for the revisionist, after keeping a photostat copy of the same on record.
