Heard learned counsel for the petitioner, learned Standing Counsel for the State and Sri Bhupesh Kumar Singh, learned counsel appearing for respondent nos. 3 & 4. Petitioner's daughter, namely, Shalini Verma was an Assistant Teacher in a Junior High School run by the U.P. Board of Basic Education. She passed away on 10.01.2024. As the petitioner's daughter was a divorcee and was living with her parents, the petitioner being her mother, is claiming the release of death-cum- retirement gratuity amount of her deceased daughter. Learned counsel for the petitioner submits that for ventilation of her grievances, the petitioner has moved several representations before the authority concerned, however, same have failed to elicit any response. Learned counsel for the respondent nos. 3 & 4 submits that as the petitioner's husband is receiving pension, therefore, she is not entitled for the relief as claimed for. However, in case she moves a fresh representation, it will be considered by the authority in accordance with law. In view of the above, the present writ petition is disposed of by providing that the petitioner may make fresh application/representation, ventilating all her grievances, supported by such documents, as may be advised, before the respondent no.3 within two weeks from today along with a certified copy of this order. On such representation being made, respondent no.3 shall make all endeavours to consider and decide the same, strictly in accordance with law, by means of a reasoned and speaking order, after giving proper opportunity of hearing to the parties concerned, as expeditiously as possible, preferably within a period of six weeks from the date of production of certified copy of this order, if there is no legal impediment.
