Neutral Citation No. - 2025:AHC:134953-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 2184 of 2025 Petitioner :- Jagriti Sansthan, Through its Secretary Ram Kishor Respondent :- State of Uttar Pradesh and 5 others Counsel for Petitioner :- Ashutosh Mishra, Vinayak Mishra Counsel for Respondent :- C.S.C., Rajiv Singh (S.C.) Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J.
1. This petition, purportedly in public interest, has been filed by the petitioner-Society, inter alia, seeking to question the renewal of the mining lease granted on 25.06.2012.
2. At the outset, after going through the averments contained in the petition, it is observed that only after indicating the working field of the petitioner-Society and various projects undertaken by it over a period of time, averments have been made seeking to question the validity of the renewal of the lease, in respect whereof, it is claimed that a complaint has already been made on 29.04.2025 to the Chief Minister of the State followed by reminders.
3. The petition, is absolutely silent as to how the petitioner-Society tread upon the said aspect of the lease and started taking interest pertaining to the validity of the lease deed.
4. A perusal of the documents submitted with the petition, and on an query being made to the counsel for the petitioner, it is indicated that so far the Society, has not undertaken anything pertaining to the mining lease. There are no averments in the petition regarding the petitioner-Society having undertaken the exercise quo other mining leases other than what has been granted to respondent No.6.
7. In those circumstances, the credentials of the petitioner-Society
in raising the issues before this Court, are highly doubtful.
8. We do not find any reason to entertain the present petition at the instance of the Society. The same is, therefore, dismissed. Order Date :- 11.8.2025 RK/Jyotsana (Kshitij Shailendra, J) (Arun Bhansali, CJ) Digitally signed by :- RAJESH KUMAR High Court of Judicature at Allahabad
