(2) In this writ petition, filed in public interest, petitioner has prayed for a writ of mandamus to appoint an independent agency, either CBI or CBID, or to initiate judicial enquiry for taking appropriate action in the matter of irregularities in the selection process of Group ‘D’ employees in District Cooperative Banks in State of Uttarakhand. (3) Learned Amicus Curiae submits that pursuant to orders passed by State Government, a two-Member enquiry committee, headed by Mr. Man Singh Saini, Deputy Registrar, was constituted and the said enquiry committee, after going through the records, has submitted enquiry report in respect of all three districts, regarding which there was allegation of irregularities in the selection. He submits that the competent authority, i.e. Registrar, Cooperative Societies, is yet to take decision, based on the enquiry report, although enquiry committee submitted its report to the State Government in September, 2022. (4) Learned State Counsel assures the Court that decision on the enquiry report, if not already taken, shall be taken as early as possible. (5) Accordingly, we dispose of this writ petition by directing the Registrar, Cooperative Societies to consider the report submitted by the enquiry committee and take appropriate decision, as per law, within four months from today. (6) Learned State Counsel shall communicate this order to Registrar within 24 hours. (7) It goes without saying that reasonable opportunity of hearing shall be provided to persons, who are likely to be affected by decision to be taken by the Registrar. (Vivek Bharti Sharma, J.)
