For the sake of convenience, factual position is being taken from RSA No. 1165 of 2012, titled as "Karnail Singh (since deceased) through LR versus Onkar Singh and others". 7. Appellant/defendant No.1 is in second appeal before this Court assailing concurrent findings recorded by the courts below. 8. Mr. Harsh Aggarwal, counsel for the appellant states that during the pendency of the appeal dispute has been amicably settled between the parties and the compromise deed dated 16.03.2024 has been drawn. Mr. Arun Singla, counsel representing contesting respondents No. 1 and 2 as well as Mr. Naveen Batra, counsel for proforma respondents No. 3 to 5 have admitted the factum of settlement and have requested that the appeal may be allowed in terms of compromise. 9. Accordingly, appeals are allowed. Judgments and decrees passed by both the courts below are set aside.
