This application has been filed seeking permission to organize Nalwar Mela/Lauhal Mela at Karsog commencing from 01.04.2025 to 12.04.2025 in the ground of Government Senior Secondary School, Karsog. It has been submitted in the application that the place where fair was organized, earlier was belonging to the Lord Shiva and Goddess Kamaksha (Kali), however, on approaching the State Government time and again, the Management Committee had donated and transferred the land to the Education Department/State Government with purpose to provide education to the children of the area and therefore, now the land, where fair was and is being organized, is belonging to the Education Department. Further that it is the only place having the space and accommodation to accommodate the Dieties, their devotees and people of different areas participating in the fair. It has also been submitted that there is no alternative place to organize the Nalwar Mela/Lauhal Mela.
It has been submitted that dates on which Mela is going to be organized are not having clash with the classes of the students as is also evident from the No Objection Certificate (NOC) issued by the Principal, Government Senior Secondary School, Karsog, wherein it has been stated that the school has three grounds
for activities of students and annual examination will be over by 29.03.2025 and thereafter, admission process will take place and therefore, the organization of Mela as proposed shall not have any impact on the studies of the students and, therefore, for organizing the fair in the school ground, School Administration and School Management Committee has no objection on certain terms and conditions enumerated in the NOC. Learned Deputy Advocate General has endorsed the submissions made by learned counsel appearing on behalf of the applicant and also the NOC issued by the Principal of the School concerned. It has been submitted by learned counsel for the applicant that earlier also vide order dated 11.03.2025 passed in CMP No.3612 of 2025 permission to organize Fag Fair in the play ground of Padam Government Excellence Senior Secondary School, Rampur, District Shimla was granted. Keeping in view the above facts, the applicant is permitted to organize Nalwar Mela/Lauhal Mela at Karsog commencing from 01.04.2025 to 12.04.2025, subject to terms and condition contained in NOC issued by the Principal of the School concerned and also, in addition, that the premises will be handed back to the Principal concerned in a neat and clean condition. Any damage caused to the property of school and
playground, will be compensated on the basis of demand made by the Principal. Law and order shall be maintained during the said period. Applicant shall also deposit a sum of Rs.20,000/- in the Students Welfare Fund of the school. In the aforesaid terms, application stands disposed of. (Vivek Singh Thakur) Judge
