SURESH REDDY CRIMINAL PETITION No. 1944 of 2025 ORDER: As per the directions of My Lord the Hon’ble the Chief Justice, this Criminal Petition has been allotted to this Bench by notice dated 25.3.2025 and the same is treated as part of the roster effective from 26.3.3025. 2. This Criminal Petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘the BNSS’), is filed by the petitioners/Accused Nos.1 and 2, seeking anticipatory bail, in Crime No.78 of 2024 of Nagarjunasagar Police Station, Nagarjunasagar, Palnadu District, registered for the offences punishable under Sections 323, 324, 509, 342, 354-A and 506 r/w 34 IPC. 3. The case of the prosecution is that on 13.5.2024 at about 10.30 a.m, while the de facto complainant along with others was going to polling booth to exercise her franchise in General Elections, the accused abused and attacked them and caused injuries to her and another. 4. Though the incident took place on 13.5.2024, the de facto complainant gave report after two days i.e., on 15.5.2024. Till today, the police did not arrest the petitioners. As the incident took place during the course of General Elections and as the police failed to 3 arrest the petitioners right from 15.5.2024 the day of giving report, this Court is inclined to grant anticipatory bail to the petitioners/Accused Nos.1 and 2 on certain conditions. 5. The petitioners are directed to surrender before the Station House Officer, Nagarjunasagar Police Station, on or before 10.04.2025. On such surrender, the Station House Officer concerned is directed to enlarge the petitioners/Accused Nos.1 and 2 on bail, on their furnishing personal bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum each, to his satisfaction. On such release, the petitioners/Accused Nos.1 and 2 are directed to cooperate with the Investigating Officer and also directed not to tamper with the prosecution witnesses in any manner. After release, the petitioners are directed to report before Station House Officer concerned, once in a week i.e., on every Monday between 10.00 a.m. and 1.00 p.m. until further orders. Accordingly, the Criminal Petition is allowed.
