JUSTICE B M SHYAM PRASAD) The respondent has successfully challenged the third petitioner's order and the consequential Endorsement refusing compassionate appointment with the Karnataka State Administrative Tribunal, Bengaluru [for short, 'the Tribunal'] in Application No.4492/2024. The Tribunal has quashed the aforesaid orders but it has directed the petitioners to reconsider the respondent's claim for appointment on compassionate grounds. - 4 - HC-KAR NC: 2025:KHC:50537-DB WP No. 33765 of 2025 Mr. Raghavendra G. Gayathri, the learned counsel for the respondent, submits that after the Tribunal's impugned order, the respondent is issued with another Endorsement dated 23.07.2025 and that the respondent has called in question such endorsement in Application No.4809/2025 with the Tribunal. Mr. Vikas Rojipura, the learned Additional Government Advocate, submits that the petition could indeed be disposed of, but without prejudice to the petitioners on the ground that the Tribunal's impugned order has not been called in question or that the petition is disposed of without interference. This Court opines that the Tribunal is yet seized of the reasons assigned by the petitioners for rejection of the respondent's application, and therefore, the petition must be disposed of without prejudice to the petitioners leaving open all questions to be decided. - 5 - HC-KAR NC: 2025:KHC:50537-DB WP No. 33765 of 2025 The petition stands disposed of accordingly.
