JUSTICE S.R.KRISHNA KUMAR Digitally signed by AASEEFA PARVEEN Location: HIGH COURT OF KARNATAKA - 2 - HC-KAR NC: 2025:KHC:52596 RFA No. 2201 of 2023 ORAL JUDGMENT This appeal by the defendant in O.S.No.8296/2016 on the file of the LX Additional City Civil and Sessions Judge, Bangalore, is directed against the impugned judgment and decree dated 28.07.2023, whereby the said suit filed by the respondent/plaintiff against the appellant/ defendant was decreed by the Trial Court, directing the appellant/ defendant to pay a sum of Rs.7,69,472/- together with interest at 12% per annum from the date of suit till realization. 2. The appellant/defendant and respondent/plaintiff have settled the matter vide Memorandum of Settlement dated 07.11.2025 before the Mediation Centre and the same has been transmitted to this Court. 3. Learned counsel for the appellant and learned counsel for the respondent along with the husband and GPA holder of respondent are present before this Court and they admit that the matter has been amicably settled between them before the Bangalore Mediation Centre and the appeal may be disposed of in terms of the mediation, settlement, agreement, entered into between the parties. - 3 - HC-KAR NC: 2025:KHC:52596 RFA No. 2201 of 2023 4. Accordingly, the appeal deserves to be disposed of in terms of the mediation, settlement, agreement, dated 07.11.2025 entered into between the parties. 5. Hence, the following ORDER (i) Appeal is hereby disposed of in terms of the mediation, settlement, agreement dated 07.11.2025 (ii) The impugned judgment and decree is modified and the suit of the plaintiff is disposed of in terms of the mediation, settlement, agreement dated 07.11.2025. (iii) The Registry of this Court is directed to refund the entire court fee paid on the memorandum of appeal back in favour of the Power of Attorney Holder of the appellant immediately without any delay. (iv) The Registry of the Trial Court is directed to refund the entire court fee paid on the plaint back to the power of attorney holder of the respondent immediately without any further delay. (v) The Registry of this Court is directed to release/disburse the entire deposit made by the appellant in the present appeal together with - 4 - HC-KAR NC: 2025:KHC:52596 RFA No. 2201 of 2023 accrued interest in favour of the power of attorney holder of the respondent immediately without any delay.
