WMP NO. 29773 of 2022 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 15-07-2025 CORAM THE HONOURABLE MR.JUSTICE MUMMINENI SUDHEER KUMAR WMP NO. 29773 of 2022 IN REV.APLW SR NO. 116997 OF 2022 The Secretary To Government Personnel And Administrative Reforms Department, Secretariat, Fort St. George, Chennai-9 and another Petitioner(s) Vs A.Soundarraj Section officer, Public Department secretariat, Fort St. George Chennai 600 009 and 14 Others Respondent(s) For Petitioner(s): For Respondent(s): M/s. In the affidavit filed in support of the above application, the respondents have dealt with the matter mainly on the merits, but this court hardly finds any reason, much less a sufficient reason, for condoning the abnormal delay of 2031 days in filing the review application. 3. Though, Mr.J.Ravindran, learned Additional Advocate General appearing on behalf of the respondents strenuously contended that the merits of the matter are required to be looked into while considering an application for condonation of delay, this court is not inclined to look into the merits of the matter, as the Hon'ble Apex Court has recently held that the merits of the matter are totally irrelevant while considering an application on condonation of delay in the case of “Pathapati Subba Reddy -vs- Special Deputy Collector” reported in 2024 LiveLaw (SC) 288. This is not the case where the respondents are unaware of the orders passed by this court as early as on 27.02.2017, since the petitioners had filed contempt petition No.2233 of 2018 as early as in the year 2018 itself, and the respondents were already put on notice about the same, which is still pending before this court. It is https://www.mhc.tn.gov.in/judis evident that the respondents were fully aware of the orders passed by this court. 4. In the light of the above, this court does not see any reason to condone the abnormal delay of 2031 days in filing the review application. Accordingly, the same is dismissed. 15-07-2025 skr (1/2) To 1. A.Soundarraj Section officer, Public Department secretariat, Fort St. George chennai 600 009 2.
