This writ petition has been filed with the following prayer:- "1) issue a writ, order or direction in the nature of Mandamus commanding to direct the respondent no.2 to decide expedite the Recall Application dated 08.04.2024 against the order dated 01.04.2024 passed by the respondent no.2 in Case No.6177/2023, Computerized Case No.T202305440106177 (Beili Vs. Ram Saware) u/s 33(3) of U.P. Revenue Code, 2006, which is pending since 08.04.2024, as early as possible within stipulated time which is pending before the court of respondent no.2." It is contended that restoration application is pending in proceedings under Section 33(3) of U.P. Revenue Code, 2006. Learned counsel for the petitioner submits that the said restoration application may be decided expeditiously. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit, the matter is being disposed of, at the admission stage, with a direction upon respondent no.2 to decide the restoration application dated 08.04.2024 pending in proceedings under Section 33(3) of U.P. Revenue Code, 2006, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of one month from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
